Mandatory reporting and limits to confidentiality
Arkansas Counseling and Wellness Services follows HIPAA and Arkansas state law. Most of what you discuss in counseling is confidential. State and federal law require us to report in a small number of situations, even without your consent.
- Suspected child abuse or neglect. Arkansas Code §12-18-402 requires us to report when we have reasonable cause to suspect a child has been or may be abused or neglected.
- Suspected elder or dependent adult abuse. Arkansas Code §12-12-1715 requires us to report suspected maltreatment of adults age 60 or older or dependent adults.
- Imminent harm to self or others. When we believe a client poses an imminent threat of serious harm to themselves or another identifiable person, we may take reasonable steps to protect that person, including contacting emergency services or warning the intended target ("duty to warn / duty to protect" per Tarasoff principles).
- Court order. A judge may compel records or testimony through a valid subpoena or court order.
For DOT SAP services, the SAP report is sent directly to your employer Designated Employer Representative under 49 CFR Part 40, not to you. This is the rule under federal regulation, not a choice we make.
